Understanding Michigan’s “Clean Slate” Laws

In 2021 and 2023, Michigan enacted some of the most progressive expungement laws in the country. These changes made it possible for thousands of residents to have their past convictions “set aside,” meaning they are removed from public view and background checks.

Automatic vs. Petition-Based Expungement

While Michigan now automatically clears certain records, the automatic system has limits. Many people still need to file a formal petition with the court to achieve a full clean slate.

  • Automatic expungement: Since April 2023, certain non-violent misdemeanors (after 7 years) and up to two non-violent felonies (after 10 years) may be cleared automatically by the state.
  • Petition-based expungement: This is often the better path for those who don’t want to wait 7–10 years. By filing a petition, we can often clear records much sooner—3 years for most misdemeanors and 5 to 7 years for felonies.

What Convictions Can Be Expunged?

The 2025 standards allow for a broader range of set-asides than ever before, including:

  • Misdemeanors: Unlimited regular misdemeanors can now be set aside.
  • Felonies: Up to three felonies can be expunged in a lifetime.
  • Traffic offenses: For the first time, most traffic convictions (excluding those causing injury or death) are eligible.
  • First-offense DUI: First-time OWI convictions can now be petitioned for expungement after a 5-year waiting period.
  • Marijuana offenses: Convictions for behavior that is now legal under Michigan’s recreational marijuana laws.
